Private hire operators

A private hire operator is anyone who accepts or invites bookings for a private hire vehicle. To be able to do this, you must have a licence.

  • An individual, partnership or company is able to apply for an operator's licence and can employ or subcontract any number of licensed private hire vehicles
  • As the operator you are responsible for complying with the conditions of your licence

Criminal records check

We have a duty to ensure you are a fit and proper person to hold an operator's licence. 

  • If you have a DBS certificate issued in the last 3 months, you can use this as evidence to demonstrate your fitness
  • If you have signed up to the DBS update service, you can supply us with the relevant information to enable us to carry out a check with the DBS
  • You can apply for a DBS certificate through the council

You will need to speak to the planning department to ensure that you can use your address as a place of business.

Demonstrating your right to work in UK

Your right to work in the UK will be checked as part of your licensing application. This could include the licensing authority checking your immigration status with the Home Office. You must therefore provide a suitable document or document combination. The list of accepted documents is set out in the guidance document. You must bring original documents, such as a passport or biometric residence permit as indicated in our published guidance, so that the check can take place. We will keep copies of documents. Original documents will be returned to you.

If there are restrictions on the length of time you can work in the UK, your licence will not be issued for any longer than this period. In those circumstances, the check will be repeated each time you apply to renew or extend your licence. If, during this period, you are disqualified from holding a licence because you have not complied with the UK’s immigration laws, your licence will lapse and you must return it to the licensing authority. Failure to do so is a criminal offence.

What happens next

As long as you satisfy all the requirements, we will contact you to grant the licence and we will send you a paper copy of your licence.

If there is a problem, then your application might be referred to the licensing committee for a decision.

If you do not agree with the decision of the licensing committee, you have the right of appeal to the magistrates' court.  If you not are sure of what the best course of action is for you, we would recommend that you seek legal advice.

Tax conditionality for private hire operators

You will need to complete a simple tax check to renew a taxi driver, private hire or scrap metal licence, or when you apply for the same type of licence with a different licensing authority.
