Overview of the Public Spaces Protection Order (PSPO)

Summary of the Order
The PSPO now covers many open spaces, parks, streets and car parks in Cheltenham.
PSPO and alcohol
When asked to by a police constable or authorised person to prevent public nuisance or disorder a person must stop drinking alcohol, and hand over any containers (sealed or unsealed) which are believed to contain alcohol.
The PSPO covers the listed designated areas.
PSPO and dogs
The effect of the PSPO is to regulate the control of dogs on council owned land.
A person in charge of a dog must remove its faeces (dog poo) from the land immediately.
A dog owner or walker must have with them an appropriate means to pick up dog faeces.
Dogs are not allowed in:
- Children's playgrounds and areas which are designated and marked for children's play
- Any games areas, for example tennis or other ball courts, wheeled sports areas
- Any bowling greens
- Marked playing pitches - when in use for playing sports
A single person can have a maximum of four dogs under their supervision in any area of council owned land at any one time. This includes the areas identified in Schedule 1.
A person in charge of a dog on land where this Order applies must comply with a direction given to them by an authorised person such as a constable or authorised council officer. It is an offence to refuse to provide personal details if requested by an authorised council officer, or to give false details.
A person who fails, without reasonable excuse, to comply with the PSPO will be committing an offence and will be liable to pay a fine not exceeding level two on the standard scale, or a fixed penalty notice of a maximum of £100.
