S106 planning obligations
S106 planning obligations may cover one or more of the following:
- restricting the use of the land or the way in which a development is to be carried out
- requiring specific operations or activities to be carried out
- requiring the land to be used in a specific way
- requiring a sum or sums of money to be paid to the local planning authority for a specified purpose
Planning obligations may also be used for a wide range of purposes. However, current government guidelines detailed in the National Planning Policy Framework (NPPF), give a clear set of rules which planning obligations must adhere to. They must be:
- necessary to make the development acceptable in planning terms
- directly related to the development
- fairly and reasonably related in scale and kind to the development
